Welcome to MyProperties Nigeria. By accessing or using myproperties.ng, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Platform.

1. Definitions

  • "Platform" refers to the myproperties.ng website and all related services.
  • "User" refers to any person who accesses or uses the Platform, including customers and vendors.
  • "Customer" refers to a user who browses, purchases, or interacts with listings.
  • "Vendor" (or "Partner") refers to a user who lists properties, services, or products on the Platform.
  • "Listing" refers to any property, service, or product advertised on the Platform.

2. Account Registration

  • You must be at least 18 years old to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and complete information during registration.
  • You may register using email/password or Google OAuth.
  • We reserve the right to suspend or terminate accounts that violate these terms.

3. Use of the Platform

Permitted Use

  • Browse and search for properties, services, and building materials.
  • Send inquiries, request viewings, and submit quotes to vendors.
  • Purchase products and services through the checkout system.
  • Apply to become a vendor/partner on the Platform.
  • Manage your account, orders, and interactions through the dashboard.

Prohibited Use

  • Post false, misleading, or fraudulent listings or information.
  • Use the Platform for illegal activities or to facilitate illegal transactions.
  • Attempt to gain unauthorized access to other accounts or Platform systems.
  • Scrape, harvest, or collect user data without authorization.
  • Interfere with the operation or security of the Platform.

4. Vendor Terms

  • Vendors must apply through the partner application process and be approved before listing.
  • Vendors are responsible for the accuracy of their listings, including descriptions, pricing, and availability.
  • Vendors must respond to customer inquiries, viewing requests, and quotes in a timely manner.
  • Vendors must fulfill orders as described in the listing and within the agreed timeframe.
  • The Platform reserves the right to remove listings or suspend vendor accounts that violate these terms.

5. Listings and Content

  • All listings must be for legitimate properties, services, or products available in Nigeria.
  • Pricing must be displayed in Nigerian Naira (NGN) and reflect the actual cost.
  • Images must accurately represent the listed item or service.
  • The Platform may remove or modify listings that violate our policies without notice.
  • Users retain ownership of content they submit but grant the Platform a non-exclusive license to display it.

6. Transactions and Payments

  • Payments are processed securely through Paystack. The Platform does not store your card details.
  • By completing a purchase, you agree to pay the listed price plus any applicable shipping fees.
  • All prices are in Nigerian Naira (NGN) unless otherwise stated.
  • Orders are confirmed only after successful payment processing.
  • The Platform acts as a marketplace facilitator; individual transactions are between the customer and vendor.

7. Inquiries, Viewings, and Quotes

  • Inquiries and viewing requests are non-binding expressions of interest.
  • Quotes submitted by customers are offers subject to vendor acceptance or counter-offer.
  • The Platform facilitates but does not guarantee the outcome of negotiations.
  • Both parties must conduct themselves professionally and in good faith.

8. Shipping and Fulfillment

  • Physical products are shipped by vendors using the shipping options available at checkout.
  • Shipping costs are calculated based on the selected method and displayed before payment.
  • Delivery timelines are estimates and may vary depending on location and vendor capacity.
  • Vendors are responsible for packaging, shipping, and delivery of physical products.

9. Refunds and Disputes

  • Refund policies vary by vendor and product type. Contact the vendor directly for refund requests.
  • For property transactions, refund terms are governed by the specific agreement between parties.
  • The Platform may mediate disputes at its discretion but is not obligated to resolve them.
  • If you believe a transaction is fraudulent, contact us immediately at info@myproperties.ng.

10. Intellectual Property

  • The Platform, its design, logo, and underlying technology are the intellectual property of MyProperties Nigeria.
  • You may not reproduce, distribute, or create derivative works from Platform content without permission.
  • User-submitted content remains the property of the user, subject to the license granted in Section 5.

11. Limitation of Liability

  • The Platform is provided "as is" without warranties of any kind.
  • We do not guarantee the quality, safety, or legality of listings on the Platform.
  • We are not responsible for the actions of vendors, customers, or third parties.
  • Our liability is limited to the fees paid to us for Platform services, if any.
  • We are not liable for indirect, incidental, or consequential damages arising from Platform use.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

13. Modifications

We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. Significant changes will be communicated via email or a notice on the Platform.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the use of the Platform shall be subject to the jurisdiction of Nigerian courts.
